Rich Myers Triumphs

In a follow-up to the Beta Pi newsletter of January 2019 regarding a United States Supreme Court case of Air and Liquid Systems Corp et al v. DeVries et al, the decision has been rendered by a 6-3 vote in favor of Respondent DeVries, represented by Rich Myers, Beta Pi ’69.

Oral argument before the Court took place on October 10, 2018, the second day new Supreme Court Justice Brett Kavanaugh joined the Court. In what may have been a shock to many who assumed that Justice Kavanaugh was a conservative, appointed by President Donald Trump, Wh ’68, and would vote along “party lines”, he joined known “liberals” on the Court, Justices Ginsburg, Sotomayor, Roberts, and Kagan, in the majority. Not only did he vote with them, Justice Kavanaugh wrote the majority opinion for the Court in a matter of such divided opinion that a dissenting opinion was also written by Justice Gorsuch. Apparently, Justice Kavanaugh is willing to vote for what he thinks is right.    

Now that the law is clear as to what conditions need to be present for liability to attach, the case is being sent down to a lower court to be tried. As the Supreme Court decision firmly supports the contentions set forth by Rich in his pleadings, success in this matter by Rich and his team of attorneys is expected.
